Tower Social Terms of Service
Version: 1.1 ยท Effective date: November 1, 2026
Welcome to Tower Social. These terms explain how our service works and what we each agree to. We kept them short and plain. Please read them, along with our Privacy Policy, before you reply "I AGREE."
Quick summary
This summary is for convenience only. The full terms below control.
- You text your Tower Social AI assistant. It plans and creates posts for your Facebook and Instagram (and TikTok and YouTube, in beta, if they're part of your plan).
- Nothing posts without approval.
- Up to 3 posts per week on Base or 5 posts per week on Growth, with up to 2 revision rounds per post. Unused posts expire at the end of each week (Sunday). No rollover, no refunds for unused posts, no extra fees.
- 14-day free trial that starts the day your first post goes live. No card is needed for the trial. When you pick a plan, we send you a secure payment link; your subscription starts once you pay, then bills monthly through Stripe until you cancel.
- Cancel anytime. You keep full service until the end of the month you've paid for, and there are no partial-month refunds.
- You keep ownership of your accounts and your content. You're responsible for having the rights to the photos and media you send us, and we use your content only to make your posts.
- We can't guarantee results like followers, views, or sales.
1. Who we are
"Tower Social," "we," "us," and "our" mean Tower Social LLC, a member-managed Arizona limited liability company (Arizona Corporation Commission Business ID 25135104). You can reach us at team@towersocialhq.com.
"You" and "your" mean the business that signs up and the person agreeing on its behalf.
2. Who can sign up
To use Tower Social, you must:
- be at least 18 years old;
- be signing up for a business (not for personal use); and
- have authority to agree to these terms for that business.
3. How you agree
Your Tower Social assistant will text you a link to these terms and our Privacy Policy. You accept both by replying "I AGREE" (all capital letters).
We keep a record of your agreement, including the date, time, phone number or email, your reply, and the version of the terms. You agree that this electronic acceptance is as binding as a signature on paper.
4. What the service is
Each client gets a Tower Social AI assistant you can reach by text. Your assistant:
- learns about your business, customers, and brand;
- checks in with you, asks for photos, videos, and news, and suggests post ideas;
- creates post drafts (captions, images, and short videos made from your content);
- after approval, schedules and publishes posts to your Facebook Page and Instagram account, and to TikTok and YouTube (in beta) if they're part of your plan; and
- sends simple recaps and reports on how your posts are doing.
What's included depends on your plan. See Section 10.
5. You're working with an AI assistant
Your assistant is an artificial intelligence (AI) system, not a person. It is supervised by Tower Social staff, who set its rules, review its work, and handle anything it can't.
AI can make mistakes. It may misunderstand a request or get a detail wrong. That's why every post needs approval before it goes live, and why you should read drafts carefully before approving.
What the assistant can't do: it cannot change prices, give discounts, issue refunds or credits, settle billing disputes, or promise anything outside your plan (like extra posts, new platforms, or guaranteed results). Only Tower Social staff can handle those, and only in writing from staff. If the assistant ever seems to promise something outside these terms or your plan, that promise does not bind Tower Social.
6. Your weekly publishing allowance
- Your plan includes up to 3 posts per week on Base or up to 5 posts per week on Growth, plus any extra posts you buy.
- Each post includes up to 2 rounds of revisions. After that, we may suggest starting a fresh post.
- A post counts toward your allowance when it is scheduled or published. One post published to several platforms (for example, Facebook and Instagram) counts as 1 post. Photos and videos you send don't count by themselves (20 photos might make 1 post, and 1 video might make 3). Edits and choosing between draft options don't count.
- The weekly cycle runs Monday through Sunday, in your local time.
- Unused posts expire at the end of Sunday. They do not roll over, and there is no credit or refund for unused posts. There are also no extra fees for weeks you don't use.
This is an allowance, not a guarantee. Your subscription pays for access to the service with a weekly publishing allowance. It does not guarantee a set number of posts per month. How many posts we can make depends on you sending content, answering questions, and approving drafts.
7. Approvals
- Nothing is posted without approval. Depending on your setup, approval comes from you, Tower Social staff, or both. Right now, Tower Social staff also review posts before they go live.
- You approve by replying to your assistant (for example, "Approved" or "Looks good").
- You may name other people (like a family member or employee) who can approve for you. Approvals from them count as yours. Tell us if that changes.
- Older or reused content always needs fresh approval, even if you approved something similar before. Menus, prices, and services change.
- When you approve a post, you confirm it is accurate and OK to publish (see Section 8).
- Once a post is published, you can ask us to edit or delete it, and we'll do so when the platform allows.
8. Your content
"Your content" means anything you send us: photos, videos, logos, music, text, offers, prices, and business information.
Fair use, in plain words: you're responsible for having the rights to every photo, video, song, and other piece of media you send us, and we use your content only to make and publish your posts.
You confirm that:
- you own your content, or have permission to use it (including any people shown in it, and any music);
- your content doesn't break any law or anyone else's rights; and
- your business claims, offers, prices, hours, and other facts are accurate. You're responsible for the accuracy of what you ask us to post and what you approve.
You give us permission (a license) to store, copy, edit, format, and combine your content, and to publish it to your accounts, only to provide the service to you. This permission is non-exclusive and ends when the service ends, except for posts already published, which stay on your accounts unless you delete them.
We may decline content that we believe is illegal, misleading, infringing, offensive, unsafe, or against platform rules. We may also hold a post for staff review when we're unsure.
We use your logo exactly as you provide it. We won't redesign or alter it. If you don't have a logo, we can design one for you (see Section 10). A logo we design is made for your social media profiles; it is not a registered trademark.
9. Who owns what
- You own your accounts, your content, and the finished posts we create for you.
- We own our assistant, templates, methods, playbooks, and know-how. We may use general lessons learned (not your private information) to improve the service.
- We won't use your business name, posts, or content to promote Tower Social without your permission (see Section 14 about the Client Spotlight).
10. Plans, trial, and billing
Plans (monthly):
- Base: $399/month. Facebook and Instagram, up to 3 posts per week, Stories (sharing your Reels to Stories is free), weekly and monthly reports, and an AI voice clone of your voice (free, only with your consent).
- Growth: $499/month. Up to 5 posts per week, and includes 1 team member.
Add-ons and one-time services:
- Extra single post: $35 each, or 4 for $119.
- TikTok and YouTube add-on (Beta): no charge while it's in beta. If we ever decide to charge for it, we'll tell you at least 30 days ahead, and you can choose whether to keep it.
- Add a team member (let another person text in posts): $10/month each.
- Logo design: $100 one-time.
- Profile makeover: $129 one-time.
- Setup fee: $0.
Founding client rate (first 10 paying clients):
- Base: $149/month for months 1-3, then $279/month.
- Growth: $229/month for months 1-3, then $359/month.
- Founding rates are locked for 2 years (24 months) from your first paid month (month 1, so the 3 intro months count toward the 2 years). After that, your plan moves to the standard price, and we'll give you at least 30 days' notice first.
- Founding prices stay locked only while your subscription stays active (if you cancel and come back later, current prices apply).
- Founding clients also get: TikTok and YouTube (Beta) included free; a free logo (3 AI options, up to 2 edits); a free profile makeover at signup; the first team member free; and extra single posts at $25 each.
Free trial. New clients get a 14-day free trial, using Base plan limits. Your trial starts the day your first post goes live (not the day you sign up or reply I AGREE) and ends 14 days later. No card is needed for the trial, and the trial doesn't turn into a paid plan by itself. We'll remind you before the trial ends.
Starting your plan and monthly billing. When you pick a plan, we send you a secure payment link. Your subscription starts once you pay through it. After that, your card is charged the price of your selected plan every month on the same date, until you cancel.
Payments through Stripe. Payments are handled by Stripe, a third-party payment processor. Your card is stored by Stripe, not by us. Never send card numbers by text. If you do, we'll ask you to use the secure Stripe link instead.
Plan changes. Upgrades and downgrades take effect at the start of your next billing period.
Price changes. We'll give you at least 30 days' notice before any price change. If you don't want to pay the new price, you can cancel before it takes effect.
Taxes. Prices do not include tax. Any sales taxes that apply will be added on top of your plan price.
Failed payments. If a payment fails, we'll let you know. If it isn't fixed within 7 days, we may pause or end your service.
11. Cancellation
- Cancel anytime by texting your assistant (for example, "cancel my subscription") or through the Stripe customer portal.
- We'll confirm your cancellation by both text and email, including the date your service ends.
- Cancellation takes effect at the end of your current billing period. Service continues until then.
- Your billing date is the day of the month you started paying. For example, if your paid plan starts on August 7, you're billed on the 7th of each month.
- No partial-month refunds. If you cancel, your account stays active through the end of the month you've paid for, and you won't be charged again. For example, if you start on August 7 and cancel on August 8, your account stays active until September 7.
- Posts already published stay on your accounts. Posts scheduled for after your service ends will be canceled.
- After cancellation, please remove Tower Social's partner access in Meta and disconnect any TikTok or YouTube connection (we'll also remove ourselves when possible).
- After your service ends: we pause posting, and your assistant stays active for 7 days in case you change your mind. On day 7 we delete your assistant and your content (no later than 90 days for any remaining copies, plus up to about 30 days in backups), except records we must keep by law. Details: Privacy Policy, Section 7. Ask before day 7 if you want a copy of your content.
12. Pausing your subscription
You may ask to pause your subscription instead of canceling. If you haven't sent anything in a while (for example, 3-4 weeks), your assistant may offer a pause so you aren't paying for a service you're not using. Pause requests are handled by Tower Social staff.
You can pause for up to 30 days at a time. During a pause, we don't publish posts, and your assistant won't send regular check-ins. Your service starts again automatically after 30 days, or sooner if you text your assistant that you're ready. You aren't charged during a pause. Your billing date moves forward by the number of days you paused.
13. Refunds and billing disputes
- Only Tower Social staff handle refunds, credits, and billing disputes. Your assistant can't approve them, but it can pass your request along.
- If you think you were charged incorrectly, contact us first at team@towersocialhq.com. We'll try to fix it quickly.
- Any refund is at our discretion unless the law requires otherwise.
14. Text messages, newsletter, and spotlight
Text messages. By signing up, you agree to receive text messages from your Tower Social assistant at the number you give us. These include:
- regular check-ins (usually Monday, Wednesday, and Thursday), a Friday recap, post drafts, approval requests, and replies to your messages; and
- service notices, such as trial and billing reminders.
Message frequency varies. Message and data rates may apply. Reply HELP for help. Reply STOP to opt out at any time.
Important: our service is delivered by text. If you text your assistant STOP (or anything that sounds like you want to stop), your assistant will first ask what you mean: (1) cancel your paid subscription, (2) pause your subscription, or (3) keep your plan but stop the reminder and check-in messages. Nothing is canceled until you confirm. If you don't answer by text, we'll ask you by email. If your STOP fully opts you out of texts before we can ask, your subscription is not canceled by that alone; we'll contact you by email to confirm which option you want.
If you texted us before becoming a client (for example, by scanning our QR code), we use your number and messages to answer you, set up a free trial, and manage our waitlist. Tips and offers by text are optional and sent only if you reply YES to that separate question; saying no never affects your trial or service, and agreeing isn't a condition of any purchase. Reply STOP anytime. See Privacy Policy, Section 6A.
Newsletter. We send all clients a free monthly Tower Social newsletter by email with updates, social media tips, and a client spotlight. You can unsubscribe anytime using the link in the email.
Client Spotlight. We may invite you to be featured. We'll only feature your business with your approval of the final article and photos.
15. Account access
- We connect to your Facebook Page and Instagram through Meta's partner access. You approve the access in your Meta settings. If TikTok or YouTube is part of your plan, you connect it through a secure link we send you.
- You keep full ownership of your accounts at all times.
- Never share your passwords with us or your assistant. We will never ask for them.
- You can remove our access anytime in your Meta settings (or disconnect TikTok or YouTube). If you do, we won't be able to publish for you, but your subscription continues until you cancel.
- We use your account access only to provide the service (for example, scheduling posts and viewing performance data).
16. Platforms are outside our control
Facebook and Instagram are run by Meta, and TikTok and YouTube are run by their own companies, not by us. These platforms may change their rules, features, or algorithms, have outages, or restrict, limit, or remove accounts or posts. These things are outside our control, and we aren't responsible for them. You agree to follow each platform's rules. If a platform problem keeps us from posting, it doesn't entitle you to a refund or credit, but we'll work with you to get back on track.
TikTok and YouTube posting is in beta. We're making it as stable as possible, but there may be occasional hiccups; if one happens, we'll fix it quickly and thoroughly.
17. No guaranteed results
We'll work hard to help your social media, but we can't guarantee results, including followers, likes, views, reach, leads, sales, or monetization (for example, YouTube or Facebook payout programs). Any numbers we share are past performance, not promises.
18. Your information and privacy
To provide the service, we store:
- your business information (from your onboarding interview and later updates);
- your content and the posts we create; and
- your conversation history with your assistant.
We use this information only to provide and improve your service. We don't sell it. We share it only with service providers that help us run Tower Social (such as AI, texting, publishing, payment, and hosting providers) and the social platforms we post to for you, as needed to deliver the service, or when the law requires.
For more details, including how long we keep information and how deletion works, see our Privacy Policy: https://towersocialhq.com/privacy
19. Confidentiality
We each agree to keep the other's private, non-public information confidential and use it only for this service. For example, we won't share your unannounced promotions, and you won't share our internal methods or pricing arrangements. This doesn't apply to information that's already public or that the law requires us to disclose.
20. Disclaimers, liability limit, and indemnity
Service "as is." Except as stated in these terms, the service is provided "as is" and "as available." To the extent the law allows, we disclaim all other promises and warranties, express or implied.
Limit of liability. To the extent the law allows:
- our total liability for any claim related to the service is limited to the amount you paid us in the 3 months before the claim arose; and
- we aren't liable for indirect or consequential losses, such as lost profits, lost sales, lost data, or harm to reputation.
Your indemnity. You agree to defend and cover Tower Social (including Kyle Paige and anyone working for Tower Social) against claims, losses, and costs (including reasonable attorneys' fees) that arise from:
- your content, including claims that it infringes someone's rights;
- business claims, offers, or prices you provided or approved; or
- your breaking these terms or the law.
21. Ending service
You can cancel anytime (Section 11).
We may suspend or end your service:
- right away for nonpayment, abuse or harassment of our staff or assistant, illegal activity, repeated requests to post prohibited content, or conduct that puts our platform access or other clients at risk; or
- for any other reason with at least 14 days' notice. You keep full service, including that month's posts, through the end of the month you've already paid for, even if the 14 days end sooner. Because you get what you paid for, there's no refund.
Sections that by their nature should continue (like ownership, indemnity, liability limits, and confidentiality) continue after service ends.
Transfer. We may transfer these terms to a buyer of the business or a company that takes over Tower Social's business. We'll let you know if that happens.
22. Changes to these terms
We may update these terms. We'll give you at least 30 days' notice of important changes by text or email. If you keep using the service after the changes take effect, you accept them. If you don't agree, you can cancel before then.
23. Disputes and governing law
- Talk to us first. If there's a problem, contact us and we'll try to work it out informally within 30 days.
- Governing law: these terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules.
- Where: any lawsuit will be brought in the state or federal courts located in Maricopa County, Arizona, except that either of us may use small claims court.
24. Other legal details
- These terms (plus your plan details and our Privacy Policy) are the whole agreement between us about the service.
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term right away, we can still enforce it later.
- Neither of us is responsible for delays caused by events beyond reasonable control (like outages, natural disasters, or platform shutdowns).
- We're an independent service provider, not your employee or partner.
